Overview
By purchasing from Griffis Seafood Co ("we," "our," or "us"), you agree to the following Terms of Service ("Terms"). Please read them carefully before placing an order.
These Terms govern all sales of fresh seafood, including online orders, phone orders, wholesale, and retail transactions.
Freshness and Availability
We specialize in fresh, never frozen seafood. Our inventory is based on daily catch availability and ocean conditions.
As a result:
- Certain products may be temporarily unavailable or delayed due to weather, seasonality, or catch volume.
- We reserve the right to modify, substitute, or cancel items if catch conditions prevent timely delivery.
- You will always be notified if your order is delayed, substituted, or canceled before fulfillment.
Catch-to-Order Fulfillment
All orders are fulfilled based on fresh catch scheduling.
- Standard fulfillment time is typically 2–10 business days from the date of purchase, depending on species availability.
- Customers will receive an estimated ship date or catch confirmation via email or text within 24 hours of purchase.
- Delays may occur during adverse weather or product availability, which are outside our control.
Refunds and Order Changes
Because our products are perishable, refunds are only issued in the following cases:
- We cannot fulfill your order within 10 business days, or
- You request a cancellation before your order has been packed or shipped.
Once seafood has been caught, processed, or shipped, all sales are final.
Refunds will be issued to your original payment method within 3–5 business days after approval.
Quality Guarantee
We guarantee that all seafood is:
- Wild-caught or locally sourced
- Hand-inspected for quality
- Packed fresh with proper cold-chain handling
Quality Issues
If you receive a product that arrives spoiled, damaged, or incorrect, you must contact us within 24 hours of delivery with:
- Photos of the product and packaging
- Your order number
We will review the claim and, if approved, provide a refund or replacement at our discretion.
Shipping and Delivery
- Orders are shipped in insulated containers with cold packs or similar preservation methods.
- We are not responsible for delays caused by carriers (FedEx, UPS, USPS) or for shipments left unattended after delivery.
- It is the customer's responsibility to provide an accurate shipping address and ensure someone is available to receive perishable goods.
Communication and Updates
By ordering from us, you agree to receive order updates via email or text regarding:
- Catch availability
- Shipping updates
- Delay notices
You may opt out of marketing communications at any time, but transactional updates are required for order fulfillment.
Dispute Resolution
We strive to resolve all matters quickly and respectfully. If an issue arises:
- Contact us directly at orders@griffisseafood.com within 10 business days of your order date.
- If unresolved, disputes shall be handled in Florida Small Claims Court located in Levy County, Florida, under applicable state law.
- Each party agrees to bear its own legal fees unless otherwise determined by the court.
Limitation of Liability
To the fullest extent permitted by law:
- Griffis Seafood Co is not liable for indirect, incidental, or consequential damages resulting from product delays, carrier errors, or spoilage due to customer handling.
- Our total liability will not exceed the amount paid for the specific order in question.
Force Majeure
We are not responsible for delays or non-performance caused by events beyond our control, including but not limited to:
- Weather conditions
- Red tide events
- Hurricanes
- Transportation disruptions
- Governmental restrictions
Wholesale and Commercial Orders
Wholesale clients agree to:
- Provide proper seafood storage and handling at their facilities
- Follow all state and local health codes
Wholesale orders may require separate agreements or deposits depending on volume.
Amendments
We may update these Terms at any time. The latest version will always be posted on our website.
Continued use of our services constitutes acceptance of the updated Terms.
